A judge in Broward County upheld the prison sentence of a Davie man convicted in the 1992 hit-and-run death of a 6-year-old girl.
Kenneth Pierce was originally sentenced to 60-years in Florida state prison. In 2000, two of the five counts were overturned and his sentenced was reduced to 40 years, and he was credited 2,759 days, or roughly 7 1/2 years, in prison.
But, somehow Pierce was given credit for each of the three counts, and with credit for gain time he would have walked out of prison a free man on Monday.
On Friday, the victim's family, along with the relatives of others involved, went to court to stop Pierce's release and ask the court to recognize this was a clerical error and that Pierce should serve the rest of his sentence as the original trial judge intended.
Broward Circuit Judge Lisa Porter agreed and ordered Pierce back to prison.
According to court documents, Pierce drove a pickup truck that ran off the road and over three girls who were playing in a puddle outside their home in Dania Beach on June 23, 1992. Nicole Rae Walker was killed. Two of her friends, Brooke Mansey and Michele Vittelo, were severely injured.
"I get a little more justice for my daughter. I am just delighted," said Suzanne Walker, Nicole Rae Walker's mother. "I just can't say that -- I am so elated and to know the fact he's not on the streets."
"I'm thankful. She remembers everything. It's just very hard," said Sherry Mansey, Brooke Mansey's mother.
Each year, the families hold a reunion on the day of the crash..
