Police arrest a man on a murder charge nearly four years after he was accused of abusing his then 5-month-old son.

FORT LAUDERDALE, Fla. -

Police arrested a man on a murder charge nearly four years after he was accused of abusing his then 5-month-old son.

Paul Day, 41, was arrested Wednesday. He was charged with non-premeditated murder.

In July 2009, Day was charged with aggravated child abuse and child neglect. According to an arrest affidavit, Day called 911 when his son Anibus Day stopped breathing. Police said the child had been crying and Day shook him.

"The baby was crying. He (Day) was involved in one of his cleansings or rituals. He became frustrated. He picked the baby up -- I actually gave him a notepad to describe and he basically showed -- it was a violent shake," said Broward Sheriff's Office Det. Mike Vadnal. "It's disgusting that you could take a 5-month-old and shake it so violently that you cause injuries like this to the baby's brain."

Anibus Day was taken to Holy Cross Hospital and then to Joe DiMaggio Children's Hospital, where doctors determined that the child's injuries were consistent with shaken baby syndrome, according to the arrest affidavit.

In December 2012, Anibus Day, 3, died at an extended care facility for children in Pompano Beach, police said. The boy never regained consciousness from his injuries.

The medical examiner ruled the boy's death a homicide, saying he died as a result of complications from a non-accidental closed head injury.

Day is being held without bond.
