‘Oh s***:’ Miami man accused of trying to rape sleeping victim

MIAMI – A Miami man was arrested Monday on accusations that he tried to rape a woman who he had just met that day and who he allowed to sleep over, authorities said.

According to the suspect’s arrest report, Erwin Przychodny, 32, met the 25-year-old victim on March 23 through a mutual male friend.

City of Miami police said the trio and some other people were drinking at a place where the mutual friend was staying at when the friend suggested that they go to a bar.

The victim told police that she was “tipsy” and “slightly drunk” before the three of them left to the bar. She said they then went to a second bar before going to a small restaurant for empanadas.

According to the report, the victim lives an hour away from Miami and asked the suspect if he knew of a nearby place where she could rent a room for the night.

Police said Przychodny told her she could stay at his house and told her, “Don’t worry. You don’t have to do anything you don’t want to.”

The victim told Przychodny, “I’m not going to do nothing,” and agreed to stay over, the report stated.

According to the report, the victim was sleeping in Przychodny’s bed when she woke up to find him on top of her, touching and biting her breast, and rubbing his penis against her vagina over her clothing.

The victim told police that her underwear and skirt were still on, but her top had been removed.

She said it was dark in the room when she allegedly pushed Przychodny off of her and told him, “Where is your friend?,” thinking that the man on top of her was the other man they had gone out with.

According to the report, Przychodny told her their mutual friend had left a long time ago and ordered her a Lyft to go home.

Police said the victim asked the Lyft driver for the information on the person who ordered it and from what address.

According to the report, the victim then contacted law enforcement and a controlled call was placed to Przychodny in which he admitted that he woke up with an erection and wanted to try to have sexual intercourse with her.

Police said Przychodny was questioned about the accusations Monday and claimed that he had told their mutual friend that he would take the victim home.

When questioned about what happened when the two were sleeping in his bed, he said, “Oh s***,” and requested legal representation, the arrest report stated.

Przychodny was arrested on a charge of attempted sexual battery.

As of Tuesday, he was no longer appearing in the jail database.
